Nagsampa sa korte ang Pasay City Prosecutor’s Office ng kasong paglabag sa Republic Act 4200 o ang “Anti-Wiretapping Act” laban kay Senator Ana Theresia “Risa” Hontiveros.
Ang resolusyon ay nilagdaan ni Senior Assistant City Prosecutor Serafin Salazar at inaprubahan ni City Prosecutor Elmer Cris Rillo.

“Hontiveros willfully, unlawfully, knowingly and secretly intercept, record, possess a copy of such record, and show or communicate to other persons, the contents of the private communication without the consent of all the parties thereto to their damage and prejudice, ” ayon sa bahagi ng resolusyon.
Ang kaso laban sa isa pang respondent na si David Kyle Venturillo ay na-dismiss dahil sa kakulangan ng katibayan.
Sa dalawang pahinang resolusyon na nilagdaan noong December 1, 2021, si Sen. Risa Hontiveros ay sinampahan ng kaso sa Pasay City Metropolitan Trail Court matapos makitaan ng probable cause.
Ang reklamo laban sa senadora ay nag-ugat mula sa reklamo na inihain ni dating Kalihim ng Department of Justice na si Vitallano Aguirre II dahil sa diumano ay ibinunyag nito ang pakikipagpalitan niya ng text messages kay dating Congressman Jacinto Paras sa isang Senate hearing noong September 2017.
Sinabi noon ni Sen. Hontiveros sa kanyang privileged speech na nadiskubre niya ang mga text messages sa pamamagitan ng isang litrato ang plano nina Aguirre at Paras na magsampa ng kaso laban sa kanya.

Sa reklamong inihain, sinabi ni Aguirre na nilabag ng senadora ang batas dahil sa umano ay hindi awtorisadong pagsilip nito sa text messages nila at ang ginawang pagsasapubliko sa mga iyon.
Sinabi ng Pasay City Prosecutor’s Office, sa pagsasampa nila ng kaso laban kay Sen. Risa Hontiveros, na bagaman at may immunity ito sa mga sinasabi nito sa mga speech at debate, hindi ito protektado sa mga gawing ipinagbabawal ng batas.
“For this reason, the immunity she invokes cannot be made applicable to her acts of possessing and communicating the private communications subject matter hereof,” saad ng resolusyon.
