BBM, malalampasan ang mga disqualification petitions

Malalampasan ng presidential aspirant na si Bongbong Marcos (BBM) ang mga petisyon para ma-disqualify siya, ayon sa dating dean ng Ateneo School of Government na si Atty. Tony La Viña,

Dahil daw ito sa “political doctrine” na nagsasabing ang mga tao ang dapat magdesisyon at hindi ang mga korte.

Aniya, hindi maaaring i-disqualify ang isang kandidato na nangunguna at nakatatanggap ng malaking suporta mula sa mga voters.

“There is also a strong argument why they should be dismissed. The ultimate one is a political question. Especially a leading candidate, you should not disqualify a leading candidate that seems to have the support of many people, because you are depriving the people of their choice. That is political law 101. That certain thing will be decided by the people and not by the courts,” wika ni La Viña.

Ang naturang doktrina ay itinuturo sa  mga law school, lalo na sa mga kaso ng diskwalipikasyon sa eleksyon.

“I teach Constitutional law, political law, and election law. When I teach this, I always tell my students, when you look at the disqualification cases, you look at the law of course, and the jurisprudence,” ayon kay Atty. La Viña.

Naniniwala umano siya na malaki ang posibilidad na hahayaan na lang ng Commission on Elections (Comelec) at ng Supreme Court na ang mga tao ang magpapasya kung ano ang kahihinatnan ng kandidatura nito sa Mayo 2022.

“I’m inclined to think that most likely Bongbong Marcos will prevail in the disqualification cases, because more than anything, the political question doctrine. The court cannot decide this, it should be the people that should decide this,” aon pa kay Atty. La Viña.

Bukod kay Atty. La Viña, ilan pang eksperto sa batas ang nagsasabing walang matibay na basehan ang mga disqualification petitions na inihain laban kay BBM tulad ni dating Department of Justice secretary Alberto Agra at UST College  of Law Dean Nilo Divina.
