Nilinaw ng Department of Justice (DOJ) na wala pang request na ipinadala ang Estados Unidos para i-extradite si Pastor Apollo Quiboloy.
Noong Enero 31 ay nakasama si Pastor Quiboloy at dalawa niyang kasamahan sa Kingdom of Jesus Christ (KOJC) sa ‘most wanted list’ na inilabas ng Federal Bureau of Investigation (FBI) dahil sa sari-saring kaso.
Subalit ayon kay Justice Secretary Menardo Guevarra, wala pa silang natatanggap na anumang sulat tungkol dito.
“We have not received any official communication from the US government,” ani Guevarra sa mensahe sa mga mamamahayag nitong Sabado.
Hindi rin umano maaaring magkusa ang Pilipinas na i-extradite ang kontrobersiyal na pastor kung walang opisyal na request.
“Extradition cannot be done motu proprio, especially if the subject is our own citizen. Any communication will be coursed through diplomatic channels,” paliwanag ng kalihim.
Ayon pa kay Guevarra, ang ganitong proseso ay alinsunod sa extradition treaty sa pagitan ng Pilipinas At Amerika. Kailangan umanong manggaling ang request sa US State Department at pag-aaralan naman ito ng Department of Foreign Affairs (DFA) ng Pilipinas kung may sapat na basehan.
“If sufficient, the DFA endorses it to the DOJ. We then file a petition for extradition with the proper RTC on behalf of the US government,” saad ni Guevarra.
“The rest of our judicial process, including appeals, follows. in case the issuance of a warrant of arrest becomes necessary, the subject may post bail for his provisional liberty,” dagdag pa ng opisyal.
Sa kasalukuyan, pinag-aaralan na umano ng DOJ kung maaari silang mag-issue ng immigration lookout bulletin o precautionary hold departure order laban kay Quiboloy.
Naniniwala rin ang DOJ na alam ng FBI kung nasaan ngayon ang pastor at ang nararapat na proseso upang magkaroon ng hurisdiksyon ang US justice system sa mga taong katulad ni Quiboloy.
